NOT being permitted to see grandson. Please help?

This could get complicated but Ill try the best I can.First only a new court order can over ride any previous court order. Now legally neither of these women should be anywhere near your grandson in this situation and should be legally temporary placed into a better suited home which is where you may like this part. Notify Child Services of this arrangement and that you are willing to take temporary custody un til your son gets better. CS should takke the child out of this home and get temporary custody from the courts til a suitable home is found in which now should be yours. You can probably get CS to help you get temporary custody under these cirstances. Now remember Grandparents dont usually have any type of visitation rights in custody battles but right now, neither of these women dont have anymore than you do. You are the best placement for this little boy. Your son may have to face possible court questioning later to get him back from you so your grandson should be with you for some time and you might get possible permanent custody if the situation doesnt improve. Now just in case CS or the courts dont approve you, have another family member willing to take custody just in case. The courts and CS usually want to place a child with family where possible. Your new daughter in law and his bio mother have absolutely no claim to this little boy and in fact his bio mother represents a breach of the court decree terminating her parental rights. So unless there is a court order over riding any previous ones, new wifey and bio mother cant over ride it themselves. Now there is no guarantee that any of this will work but its the best scenario you have and the best bet for your grandson before something else happens like bio mom kidnapping him and just plain disappearing. Collect as much evidence and/or witnesses you can as CS and you may need it in court. You dont have to prove much on bio mom as her rights are already terminated.
